When to Use a Bail Bondsman

FAQ: Do I need to use a bondsman?

If you can afford to pay the entire bail amount yourself, then you do not need to use a bail bondsman.

You can go to the jail or courthouse and post the bond for the defendant. This typically must be paid with cash or cashier’s check but each court will have its own rules for accepting payment.

Because bail in Alameda County is so high, most people cannot afford to pay the full bail amount.

This is where a bail bondsman comes in to play. A bondsman will charge only 10% of the bail amount. For example, if the bail is $25,000, which is a typical bail amount, the bondsman’s fee will be only $2500.

Usually the 10% is easier for people to come up with than the full bond amount. You should note, however, that the fee to a bail company is not refundable.
